The online sales website www.artandretro.com, hereinafter "the WEBSITE", is owned and managed by the Me&Jo store, hereinafter "the TRADE", an entity domiciled at Av. Carlemany 89b, Àtic 3, AD700, in Escaldes-Engordany, duly registered in the Andorran Trade Register with number 934113N, and with tax registration number U-803310-A. The contact email address is info@artandretro.com and the contact telephone number is (+376) 827682.
1. PURPOSE
The general conditions of sale, hereinafter "CGV", aim to define the conditions applicable to the sale, by the TRADE, of its products and services to any natural or legal person, hereinafter "the CLIENT", who purchases through the WEBSITE.
The TRADE reserves the right to adapt or modify the CGV, without prior notice and with immediate effect, with the adaptations or modifications then being applicable to all subsequent orders.
In the event of modification, the CGV applicable to the order are those that were online, and that the CLIENT accepted on the day of placing their order.
2. PURCHASE CONTRACT
The CGV, together with the particular conditions that, where applicable, must prevail over these if expressly indicated, the terms and conditions of use of the Page and the order orders contain in a clear and understandable manner all the pre-contractual information required and constitute the purchase and sale contract between the TRADE and the CLIENT.
The formalization of an order implies full knowledge and full acceptance, without reservations, of the CGV, having been expressly accepted by the CLIENT before confirming each order by pressing the "Pay" button.
The data stored in the TRADE's computer systems constitute proof of the entire transaction carried out between the TRADE and the CLIENT.
By accepting these GTCs and the data provided, the CLIENT declares, under his/her responsibility, to be a natural person of legal age or a legally established legal person with full capacity to contract.
3. PRODUCTS
The GTCs are applicable to all products and services included at all times on the WEBSITE, and the TRADE may freely modify the variety of products as well as promotions and offers at any time. Notwithstanding the above, the products or services are purchased under the price conditions in force at the time of sending the order by the CLIENT according to the available stock.
Each product has photographs that illustrate it and a descriptive sheet with all the relevant information, its brand (if available), price, and the rest of the essential characteristics. For any additional information, the CUSTOMER can contact the customer service via the email address info@artandretro.com.
The information in the descriptive sheet may not be exhaustive, so the TRADE cannot guarantee its completeness. In the event that the CUSTOMER is not satisfied, he/she may exercise his/her right of withdrawal under the conditions established in point 10 of these CGV.
4. REGISTRATION AND IDENTIFICATION OF THE CUSTOMER
The user of the WEBSITE, who wishes to purchase any of the products marketed by the TRADE, must previously register as a CUSTOMER in the “Login” section by clicking on it.
When registering for the first time, the CUSTOMER must establish a username (which must be an email address) and a password that allows him/her to identify himself/herself as a CUSTOMER and personalize his/her visit to the WEBSITE.
The CLIENT is responsible for the conservation and use of his/her username and password. In case of loss, the CLIENT can request a new password by pressing the "I forgot my password" button.
The data marked with an asterisk are mandatory and must be provided to allow the registration and identification of the client.
5. PERSONAL DATA PROTECTION POLICY
The personal data provided by the CLIENT are processed and stored in compliance with current regulations on privacy and data protection as detailed in the privacy policy.
In compliance with Law 29/2021, of October 28, on the Protection of Personal Data, the CLIENT has the rights of access, rectification, limitation of processing, portability, deletion and opposition of personal data. In order to exercise them, the CLIENT can access their data and automatically download a copy of it in a PDF or CSV file. They can also modify all their personal information found on the "My Account" page. For any other request regarding the rectification or deletion of their personal data, the CLIENT must send a communication to this effect to the email address info@artandretro.com, to which they must attach a copy of their passport or national identity document.
In the event of any violation of these rights, especially when satisfaction has not been obtained in the exercise of these rights, the CLIENT may file a complaint with the Andorran Data Protection Agency.
The CLIENT can also obtain more information about their rights by contacting the TRADE by sending an email to info@artandretro.com.
6. ORDER
The CLIENT may only place orders from the countries listed in the annex to the CGV, since the TRADE only ships to these countries.
To place their order, the CLIENT can add the products to their basket, or remove them.
By adding a product, the CUSTOMER acknowledges being informed of its main characteristics that appear on the WEBSITE (such as: name, price, composition, origin, quantity, weight, color, other particular characteristics of the product) and, where applicable, of the specific conditions of sale, and declares to accept them without reservation.
Before definitively validating the order by pressing the "Pay" button and proceeding with its payment, the CUSTOMER can check the content of their order and correct possible errors by accessing the details of their basket, and must accept, expressly and without reservation, the CGV by pressing the button "I have read and accept the General Conditions of Sale".
7. PRICES AND PAYMENT METHOD
The prices of the products and services are indicated in euros, these do not include the IGI (General Indirect Tax) and are those that appear published on the WEBSITE at all times.
For the CUSTOMER who requests the shipment of an order to Andorra, the appropriate IGI is automatically applied to the total amount of the order.
For the CUSTOMER who places an order from any of the countries established in the annex to these GTCs, the total amount of the order is not subject to IGI, but may be subject to taxes, fees or customs duties depending on the legislation in force in each country. These are the sole responsibility of the CUSTOMER.
Any inaccurate information provided by the CUSTOMER to evade IGI or customs duties and local taxes in force in the receiving country may give rise to civil fines or criminal prosecution.
Products on promotion are indicated with a specific sticker such as “PROMOTION” or “OFFER”, or with a crossed-out price, the promotions are valid at the time of the order and during the exhibition period.
The TRADE reserves the right to modify prices at any time. Orders in progress are invoiced applying, in any case, the prices published on the WEBSITE at the time the CUSTOMER completes the order.
The prices of the products indicated on the WEBSITE do not include shipping costs. These are calculated at the time of processing the shipment according to the logistics operator's rates.
The products are the property or are in storage under the responsibility of the TRADE until full payment is made. The property is transferred to the CUSTOMER at the time of payment.
Payment for the order must be made immediately on the website of the TRADE's banking partner in a secure payment environment, using a bank card accepted by the latter.
The TRADE reserves the right not to accept new orders from the CUSTOMER if the latter has not made full and regular payment of the amounts due for previous orders.
8. ORDER CONFIRMATION AND, ESTABLISHMENT AND RECEIVING THE INVOICE
Once the order has been completed and validated by the CUSTOMER, the TRADE sends an email accepting the payment and an email confirming the order. In this sense, the purchase is understood to have been made when the CUSTOMER receives the aforementioned emails.
The TRADE establishes the corresponding invoice with the billing address indicated for this purpose and attaches it to the order confirmation email. The CUSTOMER can also download it, in PDF format, from their account by accessing the “Order History” section.
9. COLLECTION, DELIVERY OR SHIPMENT OF THE ORDER
The CUSTOMER who places the order from Andorra can choose between coming to collect the order or requesting its delivery.
If the CUSTOMER wishes to collect the order, they can do so by coordinating the collection with the TRADE by sending an email to the email address info@artandretro.com. This service is free.
If the CUSTOMER prefers to request the delivery of the order to the postal address indicated for this purpose, they can do so by coordinating the delivery with the TRADE by sending an email to the email address info@artandretro.com. The delivery service has a cost of ten euros, if the total amount of the order is greater than one hundred euros, this is free. The TRADE delivers the order within 48 hours, always starting from the following business day.
Regarding the shipment of an order to any of the countries established in the annex to these GTCs, the TRADE collaborates with the logistics operator DHL. This automatically establishes the corresponding rate according to the delivery address indicated by the CLIENT. The shipping rate is included in the invoice.
The TRADE ships the order within 48 hours, always starting from the following business day and, under the shipping and reception conditions established by the logistics operator.
In order to be able to track the shipment by the CLIENT, the logistics operator provides a tracking number.
10. RIGHT OF WITHDRAWAL
The right of withdrawal only applies to orders placed and collected or delivered in Andorra. In this sense, the TRADE only accepts the return of the product(s) purchased and collected or delivered in Andorra.
Within seven calendar days of receipt of the products, the CUSTOMER may exercise their right of withdrawal by communicating their decision to withdraw from the purchase of the product(s), by sending an email to info@artandretro.com containing an unequivocal statement indicating their decision to withdraw from the product(s).
The CUSTOMER must return the product(s) in the same condition and under the same shipping conditions and without any other manipulation than that necessary to verify their nature, characteristics or operation together with a copy of the confirmed order.
The TRADE proceeds, after receiving and verifying the shipping conditions and the correct condition of the product(s), to refund the corresponding amount, through the same system used to make the payment, within a period of thirty calendar days.
As for the rest of the countries, and only in the event of breakage of the product(s), the logistics operator's insurance, if it has been contracted by the TRADE due to the type of product(s) or their fragility, always at the latter's discretion, will cover the compensation established for this purpose.
11. LIABILITY
The TRADE is not responsible for damages and losses suffered by the CLIENT or any third party when the possible delay or breach of obligations is derived from the shipping procedure, computer viruses, external intrusions, failures in the operating system, network overloads, or any other intervention by third parties outside the TRADE.
12. GUARANTEE
The TRADE does not offer any type of guarantee on the products offered given the type of products.
13. CUSTOMER SERVICE

14. APPLICABLE LEGISLATION AND JURISDICTION
The GTC are subject to Andorran legislation and the jurisdiction of the Andorran courts for the resolution of conflicts that may arise from their interpretation or application.
